Here's a little bedtime stiory for ya kiddies. Once upon a time, when I was just a boy, I was pulled over by the police for speeding (which I was). Being a young man with a bit of an attitude, I was of course treated as such by the officers. Upon a search of my vehicle, the officer found a small pocket knife in my glove compartment. I was in the process of moving from one house to another at the time and had my car filled with other personal effects as well. I was arrested and charged with unlawful use of a deadly weapon. An arrest that would indeed alter the course of my life. I was going through the process of entering the police academy at the time. This felony arrest disqualified me from that process. Over the next years I was hassled, interrogated, abused and generally treated like a common thug by all police I came into contact with in an official capacity.

Now we have a 78 year old woman pulling a shotgun on an 8 year old girl scout and her father and the police and prosecuter REFUSE to take action. If ever there were a case of UUW, this must be it. They say she might be crazy. All the more reason to to put her BLEEP on the floor and cuff her quickly before the "crazy" can be unleashed again. I wonder what might have happened if the firefighter father had taken the weapon from her hand and bashed her nose in with the stock. I bet he would have been arrested and charged. We would see that poor old "crazy" woman on Fox News 3 times a day crying about her ordeal.

And what lesson has this 8 year old girl learned? That when you get old and crazy you can do what you want without consequences. Maybe the family of that little girl should consider civil action for emotional distress. I'm sure these old crazy people have little more than "a pot to piss in", but if it were me I'd take the pot. They might even get lucky enough to take the house and force the scared old crazy lady to be put in a home where she belongs.

We can no longer sit back and allow the powers that be to protect and serve us as they should. The cops are more concerned with having a badge and gun than doing the job. The DAs are too focussed on the the ladder of political power. I'd be ashamed to admit I was paralized with fear of the AARP. They might be a huge voting block today but they will die soon and that is life. We have the right to take back our streets and neighborhoods, with force if need be.

Uh huh, sure. I have to ask, what the other personal effects were? Shotgun? 22? 30-06? A pocket knife unless being wielded is not a weapon of concern to the police. Also, if you were a "boy" as you put it, why were you driving? Sounds like you were a young man, speeding, carrying concealed weapons.

Tell us the whole story.

Insofar as the woman and the shotgun. Actually she was being harassed in her home and thought it was those harassing her when she opened the door.

Oh how cute for you to chime in on something you OBVIOUSLY know nothing at all about. Under the legal definition of UUDW, the weapon only has to be within arms reach or readily accessable. And who in the world must you believe yourself to be to question my honesty. You have actually proven my point for me so thanx ever so much.

If you take the time to read the story you'll find out that her actions were not so innocent but I'll leave it up to you to do your research because I have no time or energy to educate the ignorant. If you were just stupid I'd have to give you a break but speaking out of turn from ignorance is just plain lazy.

Great points by both responses before mine! That's why to the blogg owner I originally cheered:it was an honest mistake, many of your other points on our screwed up legal system are correct, but please be like me where I'm actually 1000 fold MORE careful on not punishing the wrong person for a crime they didn't commit than even our legal system!itself!

I grew up with pocket knives and married into a family of hunters. I know that a pocket knife is one that has a blade of 4" or under, locks, and is not spring loaded. This can be carried concealed or open. Anything over 4" must be carried in the open, locking blade or not. All spring loaded knives (switchblades) are illegal to conceal.

So, was it a switchblade (springloaded) or over 4", which went against the conceal and carry law?

It was a butterfly knife. The blade was under 4 inches but was concealed within the handle which made an illegal weapon.

I see you are a fan of semantics....I can play that game now that the issue has been shifted to my story instead of the ordeal of an 8 year old girl scout.

When I was stopped for speeding that night, I did indeed have a shotgun in the vehicle. It was being transported broke down in plain sight. The shells were in a locked ammo box. Upon a registration check of the shotgun it was discovered stolen from a sherrif's residence in Springfield Illinois. The knife was taken during the illegal search of my vehicle. After closer review and my very vocal objection, it was revealed that the arresting officer ran the wrong number and the gun was in fact legal and being transported legally. The gun and ammo were released to me that very night. If not for the gun coming up stolen, a search of my vehicle would have required my consent or addition probable cause of which there was NONE. I believed the matter to be resolved and disposed of until I was arrested 2 weeks later on a felony UUDW charge for the knife. It did not matter that the knife was a gift from a family member and was in fact out of my home for the first time, only being transpotred from one residence to another. It was 1990 and I was 19 and I was scared to death of going to jail. I pled NC to a misdemeanor "switchblade" charge.

For good or bad that is the truth to be judged fairly and honestly. The only shame I have is that I was not strong enough or confident enough to fight with all my heart a
