No Wonder I hate HOAs !!!!! no common sense at all.............. this guy has gone thru hell and they dont want to help at all. from Local 6 The Sanford man whose wife and son were killed when an airplane crashed into their home may have to tear down his rebuilt house because a homeowners' association said he is breaking their rules.

 

Joe Woodard's wife and son were killed in the July 2007 crash, and he's been building a new home on the same lot for the past year.  the House of Management Enterprises, which represents the homeowners' association, said the home, which is a few weeks from being completed, does not fit their standards and are demanding that the house be torn down.

 

 

According to Woodard, the association wants him to build the exact home he had before.

 

"The room my wife and I had together, the room my son had ... I don't want to relive everything day by day over again," Woodard said.

 

In a letter sent to Woodard from the attorney of the homeowners' association, three specific items were mentioned. The shingles on the home and the elevation are not consistent with the community, and the home extends a few feet longer in the back than association standards allow, the letter stated

I, too, happened to see that segment and I was genuinely appalled. The sheer audacity of the HOA to dictate to that man under the horrendous circumstances which he has been wrought with. I can understand the need for certain conditions to be met and enforced by the HOAs around the World, however, there should always be exceptions pertaining to certain situations. Perhaps some type of clause or by-law should be enacted for situations like this.

While he never in a million years expected what happened, rules are rules and he signed off on them when he purchased there. As far as the poor defense of not having to relive the events of that day, no one has said the home had to be exact on the INSIDE. Reconfigure the inside, case closed. Or, if that doesn't work...MOVE. And as far as exceptions, what a moronic statement. Do for one, have to do for all or face a BS lawsuit...

The HOA can make exceptions mr nobs. That too is in the bylaws. They just want to flex their muscles and try to make someone bend to their dictatorship, for which he doesnt have to.

NOBSHERE, I speak from experience when I say that pertaining to HOAs and life in general, there are exceptions to EVERYTHING. That being said, the moronic statement you attributed to me would reflect more accurately unto yourself.

I'm sorry for what happened to this man but he is clearly breaking the rules. If these were city rules or state rules he would not be allowed to continue building. This is a private community he moved in to. What makes it private are the rules he moved there for and the same rules he now believes he should be allowed to break.

Rather than look for exceptions he should have submitted his plans for approval and then built accordingly. It's pretty clear that he didn't follow the process. Anytime that happens a red flag goes up telling me there is probably a reason why the person didn't follow the right steps, like he knew he was breaking the rules but wanted to be in a stronger position before going in front of the board. Now he is in a "Oh poor me" position where he can get sympathy to get away with breaking the rules.

In today's world everyone is a victim and everyone wants special treatment. Gee I wonder why kids act the same way.

I want to drive an Aston Martin Vanquish but at this moment drive a car a lot less expensive !! I like flying with Microsoft flight simulator, and online gaming with Half Life. I love living here -could it be better?-sure but it could also be a lot worse. I get homesick every time the soccer season starts ! Thats all folks ! :-)
