We found more than 100 examples in the the Metro East of convicted criminals collecting tax payer money for baby-sitting jobs.

It's part of a program that came out of the 1996 Welfare Reform Act. Parents who want to get back to work or school can ask a family member, friend or neighbor for help watching their child. The baby-sitter then gets paid about 50% from the State and 50% from the Federal Government.

In Missouri, those child care providers still must have background checks and it shows. I ran hundreds of names without finding anyone with a criminal record.

In Illinois, I found one felon after another. Government officials told me violent offenders are not supposed to provide child care. However, in this program, these providers are allowed to police themselves. I'd love to hear your response to this report that runs Monday night on Fox2 News at Nine. I think you'll be interested to see what Officials have to say.

Chris,

This does not surprise me. In Missouri background checks are the norm for those who are contracted with the state. I run them all the time on employees and volunteers. Illinois needs to wake up and take some action.

OMG That is awful.Somebody needs to wake up.It is one thing when a check is done and no criminal history and are sicko's around children but to know it and paying them is another.Can't wait for your story.

I have a question. Does the parent have to show that they are working or going to school or just take thier word?Just wondering how many aren't working or going to school and spliting the money with their family member. I'm not saying that some aren't trying to better themself but I heard stories about people in Missouri working the system. I just makes me mad that when people that work the system get help when they don't need it and when people that need help can.

Good question boysx2. I wondered the same thing. Working parents are required to show timesheets or other proof they're working. I'm told those time sheets are then cross checked against hours providers claim to be working.

Chris: There is only one true child care/day care provider type of facility. This is a structure built exclusively for the purpose of watching, caring for, and educating children not old enough for the school systems (which includes before/after school care up to age 12). The other form of "daycare" is the at home babysitting. Absolutely no daycare at home should be in the same class as a state approved child care facility. These babysit at home jobs are usually parents not working and decided that hey, we ought to bring in 4 or 5 more kids and make money while watching our kid. It's all DVD's, playing outside, and napping. (I bet I'll hear from the at homers - LOL - I know the truth.)

As for the State of Illinois and their extremely strict (true daycares) rules, see Licensing Standards for Day Care Centers Part 407 under Staffing section 407.110

Section 407.110 Background Checks for Personnel

The day care center shall require all persons subject to background checks, as defined in 89 Ill. Adm. Code 385.20, to furnish written information regarding any criminal convictions, to submit to fingerprinting and to authorize the background checks required by 89 Ill. Adm. Code 385, Background Checks.

Thanks for your input Edly1. The court file on Cox mentions an option to knock down her felony to a misdemeanor upon successful completion of restitution and probation. However, the final court record still shows a felony. I also called the Madison County State's Attorney's office to check on anything that may not be in the file. A representative told me there was no change -- she confirmed the final result was Felony State Benefits Fraud.

I find this story pretty sad. It sounds like you are against people making honest money. I really dont think it matters if someone has a felony conviction. What matters is if they take good care of the children they are paid to watch.

I know dozens of people who have no felony convictions that I wouldnt let watch my kid for a second. I personally have a felony conviction.... does that mean I shouldnt be allowed to watch my own kid?

My felony conviction was over 20 years ago. I havent been arrested since and I havent even spoken to a cop for the last ten years or better. Do you have any idea of how many jobs I cant get because of a few teenage moments of stupidity? And you want to take a simple job away from a decent hard-working American. And who do you propose to replace these people with? Illegal Aliens?

Another thing... who in the hell says you should be allowed to pry into peoples personal lives? Just to make ratings and enhance your career. You certainly are one of those "Holier Than Thou" people arent you?

But you are an example of what Fox2 stands for these days. It doesnt matter if you get the story right or who you hurt in the process of getting your ratings. Fox2 has no intergrity anymore. You'll pound a story into the ground. All in the name of ratings and money.

Why dont you do a story on people getting convicted wrongly of felonies because they cant afford a laywer to get them out of it? Or the people who have committed real bad felonies but have paid their way out of it?

Chris, just to let you know, I am Julie's daughter and she is no longer on probation and she has paid all of her fines. Therefore it should not be a felony. Besides, you dont know the story behind why she had to get state assistance.

Chris, I know this is a serious issue and it's a shame. I'm the mother of an autistic son who has not been out in 9 years since he was born. Why because I don't trust anyone to sit for my son. He's handicapped and easier to take advantage of. There no way he could tell me if someone did.
These mothers need to know if it is safe for thier child to stay with the sitter provided.

This comment goes out to SPEEDY62269 for your information my "other form of daycare" home IS LICENSED THROUGH THE STATE..WE HAVE RULES AND REGULATIONS TO FOLLOW JUST THE SAME AS THE OTHER FACILITY YOU SPOKE ABOUT IN YOUR COMMENT...I HAVE BEEN AN IN HOME DAYCARE PROVIDER FOR 19 YEARS AND MY HOME IS JUST AS STRUCTURED IF NOT MORE SO THAN THE "OTHER" FACILITY YOU SPEAK OF.. It's the parents that should care more about whose watching their kids. Parents on this particular program have the option to use friends,families or licensed facilities or homes.

The State has minimum guidelines as far as unlicensed providers, they must self certify and pass a CANTS check. Trust is implied by the parent, if that parent has the confidence to leave their children alone with another relative or friend and that relative or friend meets all other eligibility factors (to the States best knowldge), then what can the State do about it?

Thanks for the input discover007. After I completed this report, I spoke to a single parent who participates in this program (You should be hearing from her in a future follow-up). She told me she's surprised the babysitters don't undergo background checks even though this is a "family, friends and neighbors" program. I challenged her with the Illinois position that this is a parent's choice and that parents should know their sitter's backgrounds. Her response to me was that she could know someone for a decade and still not be aware of their background (besides not having the resources to check). Also, as far as your question "what can the State do about it?" Missouri does background checks, even in this "family, friends and neighbors" program.
